If you have any questions, feel free to contact me at (303)-866-3567 x8144 or at <br />clayton.wein@state.co.us. <br />The Bowie Resources, LLC (BRL), Bowie No. 1 Mine's Permit Revision 05 (Division File No.C-1981-038). This permit <br />revision is proposing a change in post -mining land -use at the Bowie No. 1 Mine's loadout facility from the currently <br />approved land -use of cropland to a new land -use of industrial or commercial. The Division received BRL's PR -05 <br />application on 11/1/2016, deemed it complete on 3/24/2017, and is currently reviewing the application for technical <br />adequacy. Below are the answers to the questions you posed in your 4/25/2017 and 4/26/17 emails. <br />Temporary and permanent land -use changes are approved at the county level. The Division does not have any <br />regulatory authority over land -use changes and does not dictate county land -use. Following a county land -use change at <br />a mine site, an operator must submit a Permit Revision to reflect that change. With the submittal of PR -05, BRL is <br />starting the Division's required process in anticipation of the county approving the land -use change. The Division, <br />however, will not approve a land -use change unless and until the county approves such a change. At that point, the <br />Division must approve the land -use change in the mine's permit. If the county does not approve the proposed land -use <br />change, the Division will not approve PR -05. <br />Even if the county approves a land -use change at the Bowie No. 1 Mine's loadout area, the lands would still be under the <br />Division's jurisdiction until BRL applies for and successfully receives final bond release and termination of jurisdiction. If <br />the county approves an alternate post -mining land -use of industrial or commercial, the Rules (specifically Rule 3.03.1(3) <br />(e)) require that the Division maintain adequate bond monies "to achieve compliance with the standards for revegetation <br />applicable to the pre -mining land -use..." This Rule ensures that, in the event the alternate post -mining land -use of <br />industrial or commercial is not achieved, the site will still be adequately reclaimed. This Rule also ensures that a viable <br />post -mining land -use is achieved regardless of who owns the property. Additionally, if PR -05 is approved, the Division <br />will not release any bond monies until the alternate post -mining land -use of industrial or commercial has been achieved. <br />This process includes application by BRL, notice to adjacent landowners, a site inspection and evaluation that may <br />include adjacent landowners, and public comment periods. <br />To access information and maps for the Bowie No. 1 Mine our website has a link to the public records. <br />http://mining.state.co.us. On the main page of the website there is a tab labeled Reports and Data. Select the Imaged <br />Document Data drop-down from this menu. This will take you to a page with a link to our Laserfiche database. On the <br />web page for Laserfiche there are a few fields that will appear on the left hand side of the page. There is a field to type <br />in the Permit Number (C1981038), a field labeled "IBM Index Class Name" (Select the "Permit File" option from the drop <br />down), then click on "Search" on the bottom left of the page. This will pull up the permit file for the Bowie No. 1 Mine. <br />The fields at the top of the page can be organized if you click on the "Section_ Exhibit Name" column title once. After <br />this is completed the Loadout Maps will be on the bottom of tab 7 and on tab 8.
