Amended Application for Underground Water Right and Change of Water Right
Case No. 13 CW 3081
Ruling of Referee and Decree
Page 5
Thousand Three Hundred Forty-Six (5346) feet, the general course of said
ditch being thence in a general southwesterly direction about Five Thousand
Eight Hundred Sixty-Six (5866) feet onto the land of the Petitioners.
iii. Source: Colorado River.
iv. Appropriation Date: April 1, 1907
V. Amount: 2.26 c.f.s.
vi. Decreed and Historic Use: Irrigation of up to 113 acres.
14. Change Requested:Co-Applicants request that the 102.51 acre feet of historical consumptive
use for the Senior Evans Ditch, as shown on Table 4, be quantified and changed for
augmentation and replacement of out-of-priority depletions from domestic or irrigation uses
within the West Divide service area boundaries. West Divide intends to use these
consumptive use credits as a substitute supply for its plans for augmentation including those
decreed in Case Nos.: 94CW344,02CW 123,02CW225,02CW 165,05CW 148,05CW296,
and 07CW229, Water Division No. 5, and plans that may be decreed in the future. This
additional water supply will protect against future Colorado River calls placed by the Grand
Valley Project and others. As historically operated, these credits will only be used to supply
augmentation water for domestic and irrigation uses by West Divide contractees. West
Divide's use of the consumptive use credit amounts shall not exceed the values shown in
Column 5 of Table 4.
A. Historical Consumptive Use: The Senior Evans Ditch was decreed for the irrigation
of l l3 acres_ There is also a junior Evans Ditch water right, which is not subject to
this Application, which was decreed to irrigate a total of 168 acres, including the
same 113 acres under the Senior Evans water right. A summary of the historical
diversion records for the Senior Evans Ditch from 1950 to 2013 is attached as Table
1. A review of historical aerial photographs shows that the irrigated acreage on the
property has varied over time. The maximum number of acres irrigatedwas 122 acres
from 1962 through about 1980. The maximum area of historically irrigated land at
the property (122 acres) is shown in Figure 2; 113 acres of the 122 acres has been
retired from irrigation in support of this Application and will not be irrigated by the
junior Evans Ditch water right in the future. See Figure 2.The historical consumptive
use associated with irrigation diversions made under the Senior Evans Ditch was
assessed on a monthly basis by using aerial photographs showing the historically
irrigated acreage over time, the irrigation water requirements associated with those
acreages up to the maximum 113 acres irrigated by the Senior Evans Ditch, irrigation
diversions attributed to the Senior Evans Ditch, and an irrigation efficiency of 45%.
Results of the monthly assessment are shown in Table 2. The average annual
historical consumptive use associated with the Senior Evans Ditch is 103.18 acre
