Box 1478 <br /> Rifle, CO 81650 <br /> 2. The statements in the Application are true and correct, except as otherwise noted. <br /> 3. Report of the Division Engineer. The Court has given due consideration to the Division <br /> Engineer's Summary of Consultation dated February 14, 2014, the Response to Division <br /> Engineer Report dated August 12,2014,the Division Engineer's Summary of Consultation <br /> dated October 7, 2015 and the Response to Division Engineer Report dated November 6, <br /> 2015. <br /> 4. A timely statement of opposition to the Application was filed by the Colorado River Water <br /> Conservation District, acting by and through its Colorado River Water Projects Enterprise <br /> ("CRWCD"). The CRWCD has stipulated to the entry of the Ruling of Referee and Decree. <br /> The time for filing statements of opposition has expired. <br /> Findings Re: First Claim for Relief <br /> (Underground Water Right) <br /> 5. Name of Structure and Well Permit Information. Una Gravel Pit No. 2 (the"Pit"). Elam is <br /> currently mining sand and gravel at the Pit pursuant to DMG Permit No. M-80-080, Well <br /> Permit No.74823-F (attached as Exhibit A)and an approved Substitute Water Supply Plan <br /> for January 1,2010 to December 31,2018 ("SWSP").Upon issuance of the decree sought in <br /> this case,the existing well permit will be amended through application for a new well permit <br /> to ensure the permit is consistent with the decree. <br /> 6. Legal Description of Structure: The Pit is located in the NE 1/4 NW 1/4 of Section 34 and <br /> the SE 1/4 SW 1/4 of Section 27, Township 7 South, Range 96 West, 6th P.M., at the <br /> location shown on the map attached hereto as Figure 1. The center of the Pit is located as <br /> follows: 2,345 feet East of the West line and 235 feet South of the North line of Section 34. <br /> 7. Source and Depth: The Pit is a gravel pit located in alluvial deposits adjacent to the <br /> Colorado River and will intercept and withdraw groundwater tributary to the Colorado River. <br /> The estimated total maximum depth of the Pit will be twenty-five(25)feet and the depth to <br /> groundwater is approximately eight(8)feet. <br />
