Descri tion of water rights to be used for au entation: The Colo <br /> Conservation District (the "District") owns and operates a reservoir, known as <br /> Mountain Reservoir. Water is supplied to Wolford M Wolford <br /> ountain Reservoir by Muddy Creek and <br /> its tributaries. In addition, the District has a contractual right to water deliveries from a <br /> reservoir, known as Ruedi Reservoir, which is owned and operated by the United States <br /> Bureau of Reclamation. Ruedi Reservoir is supplied by the Fryingpan River. For the <br /> purpose ofreplacing all of its out-of-priority depletions,the Company has agreed to purchase <br /> water from the District's water supplies decreed to Wolford Mountain Reservoir and/ <br /> Ruedi Reservoir (collectively the "Reservoirs" <br /> Contract with the District, dated effective June 30, 2003, ti h an initial term of up to ong-term Water Supply <br /> years and the possibility ofrenewal for a secondary term of thirty-five years(the"Contract'). <br /> The Contract contains terms and conditions consistent with the District's"Water Marketing <br /> Policy." The water rights associated with the Reservoirs are described as follows: <br /> A. Wolford Mountain Reservoir. <br /> Case No. 87CW283 <br /> i• Decree Date: November 20, 1989. <br /> ii. Legal Description of Place of Storage: The dam is located in the SWUM of <br /> the NE %<of Section 25, T. 2 N.,R. 81 W., 6th P.M. The intersection of the <br /> dam axis with the right abutment will occur at a point which bears W. <br /> 54°54'20"E.a distance of3,716.46 feet from the NW Corner of said Section <br /> 25. <br /> iii. Source: Muddy Creek and its tributaries. <br /> iv. Amount: 59,993 acre feet conditional;of this amount,32,986 acre feet were <br /> made absolute forpiscatorial and recreational uses by decree entered in Water <br /> Court Case No. 95CW251. <br /> V. Appropriation Date: December 14, 1987. <br /> vi. Use: All beneficial uses, including but not limited to domestic, municipal, <br /> agricultural and recreational uses,which uses satisfy the requirements of the <br /> Windy Gap Settlement made with the Municipal Subdistrict of the Northern <br /> Colorado Water Conservancy District;use to meet the water requirements of <br /> the inhabitants of the District for all uses,including uses in the Middle Park <br />
