The issuance of this permit <br /> does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from <br /> seeking relief in a civil court action. <br /> 2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval <br /> of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation <br /> Contractors in accordance with Rule 18. <br /> 3) Approved pursuant to CRS 37-90-137(2)and (11)for an existing well(gravel pit pond),previously operated under permit <br /> no. 74823-F,on the condition that this well is operated in accordance with the Elam Construction, Inc.Augmentation Plan <br /> approved by the Division 5 Water Court in case no. 13CW3081 for Una Pit No.2, Division of Reclamation,Mining&Safety <br /> Permit Number M-80-08. If this well is not operated in accordance with the terms of said decree,it will be subject to <br /> administration including orders to cease diverting water. <br /> 4) This well is subject to administration by the Division Engineer in accordance with applicable decrees,statutes, rules,and <br /> regulations. <br /> 5) The average annual amount of ground water to be appropriated shall not exceed 211.42 acre-feet(as decreed)with the <br /> total surface area of the proposed ground water pond limited to 62.0 acres. <br /> 6) During gravel mining operations the use of ground water is limited to evaporation,dust suppression,product moisture <br /> losses for a maximum of 700,000 tons of mined aggregate.plant operations,and dewatering(at a maximum of 1,800 <br /> gpm). Upon completion of gravel mining operations the use of ground water is limited to evaporation. No other use of <br /> water is allowed unless a permit therefore is approved. <br /> 7) The owner shall mark the well(gravel pit pond)in a conspicuous place with well permit number(s)and court case <br /> number(s)as appropriate. The owner shall take necessary means and precautions to preserve these markings. <br /> 8) A totalizing flow meter or other measuring devices shall be installed as required by the Division Engineer so as to <br /> measure any pumping from this gravel pit pond. The owner shall maintain the measuring devices in good working order. <br /> Permanent records of all diversions from the gravel pit pond,tonage of mined product,and the surface area of ground water <br /> exposure shall be maintained by the well owner(recorded at least annually)and submitted to the Division Engineer upon <br /> request. <br /> 9) Pursuant to Rule 17.1.5 of the Rules and Regulations for Water Well Construction, Pump Installation,Cistern Installation, <br /> and Monitoring and Observation Well/Hole Construction Rules,the owner has provided (under permit no.65387-F)a site <br /> plan and cross section drawings showing the extent of intended excavation,the maximum depth of the pit,and the initial <br /> static water level. <br /> APPROVED <br /> JPM - <br /> State Engineer By <br /> Receipt No.3677258 DATE ISSUED 01-04-2017 E PIRATION DATE N/A <br />
