Amended Application for Underground Water Right and Change of Water Right <br /> Case No. 13 CW 3081 <br /> Ruling of Referee and Decree <br /> Page 9 <br /> 30. Applications for reasonable diligence for the conditional water right decreed herein shall be <br /> filed by the owner or user of such right,at the times and in the manner specified by C.R.S. § <br /> 37-92-301(4)(a),if such owner or user desires to maintain the same,or until a determination <br /> has been made that such conditional right has been made absolute by reason of the <br /> completion of the appropriation. The Applicant shall file an application for a finding of <br /> reasonable diligence in the same month six years from the date of the Water Judge's Order <br /> set forth in the judgment and decree of the Court confirming this Ruling. <br /> 31. Pursuant to Rule 9 of the Uniform Local Rules for All State Water Court Divisions,upon the <br /> sale or other transfer of the conditional water right awarded herein, the transferee shall file <br /> with the water court having jurisdiction a notice of transfer which shall state: <br /> A. The title and case number of the case in which the conditional decree was issued; <br /> B. The description of the conditional water right transferred; <br /> C. The name of the transferor; <br /> D. The name and mailing address of the transferee; and <br /> E. A copy of the recorded deed_ <br /> The owner of said conditional water right shall also notify the Clerk of the Division 5 Water <br /> Court of any change in mailing address. The Clerk shall also place any notice of transfer or <br /> change of address in the case file for this case(Case No. 13CW3081). <br /> 32. In consideration of the specific findings and conclusions made herein and in conformance <br /> with C.R.S. § 37-92-304(6),the approval of the change of water rights decreed herein shall <br /> be subject to reconsideration by the Water Court on the question of injury to the vested water <br /> rights of others starting from the date of the decree and continuing for a period of 5 calendar <br /> years from the date 90% for the decreed HCU credits for the Senior Evans Ditch decreed <br /> herein have been used pursuant to one of Co-Applicant West Divide's decreed plans for <br /> augmentation. Co-Applicant West Divide shall file a notice with the Court and the Division <br /> Engineer when this threshold of use is met and if no petition for reconsideration is filed <br /> within the subsequent 5 calendar years, the Water Court's retained jurisdiction for this <br /> purpose shall automatically expire. <br /> 33. This Ruling shall be filed with the Water Clerk subject to judicial review. A copy of this <br /> Ruling shall be filed with the State Engineer and the Division Engineer for Water Division <br /> No. 5. <br />
