To: Elliott Russell, Environmental Protection Specialist <br /> Re: Special Use Permit No.228 <br /> April 20,2017 <br /> Page 2 <br /> Use Division I. Zoning, Chapter 17.12 of the Pueblo County Code. If the Similar Use <br /> Determination is approved, a Special Use Permit for this specific site would then need to be <br /> submitted to allow the processing of inert material. These two (2) applications would need to be <br /> heard by the Pueblo County Planning Commission and there is an application fee of $315 for <br /> the Similar Use Determination and a fee of $735 for the Special Use Permit. These fees are <br /> nonrefundable should the application be denied by the Pueblo County Planning Commission. <br /> Staff also noticed through review of the inspection report that there was a scale house <br /> constructed on the property. A search of the files did not find that the owner submitted a plot <br /> plan for review and zoning authorization. Staff also contacted the Pueblo Regional Building <br /> Department and found that a building permit was not issued for the building. The property <br /> owner will need to obtain zoning authorization for the scale house from Planning and will also <br /> need to contact the Pueblo Regional Building Department to determine if a permit is required. <br /> Further research has found that prior to Planning approving zoning authorization the property <br /> owner will need to document that the property was created in its current configuration prior to <br /> enactment of the Pueblo County Subdivision Regulations (August 31, 1972). If the property <br /> owner can document subdivision compliance a Certificate for Parcel of Record can then be <br /> submitted for review and approval.
