Tenant <br /> shall forward to Landlord monthly reports reflecting the quantity of sand,gravel and <br /> aggregate sold during the preceding month according to load tickets with dates of <br /> r loading. The reports shall be mailed to Landlord by the 10' day of the month <br /> following any month in which sand,gravel and aggregate are sold by Tenant. Tenant <br /> shall keep accurate record of all sales of sand, gravel and aggregate. <br /> 7. Contingency. Except for the nonrefundable portion of the royalty prepayment <br /> referenced in Paragraph 6, above, this Lease(and all of the rights and obligations of <br /> the parties under this Lease),is contingent on Tenant obtaining all necessary permits <br /> for its option on the Property no later than December 31, 2000. Should Tenant be <br /> unable to obtain all necessary permit documents by December 31, 2000, Tenant shall <br /> have the right to extend this Lease for two six month extensions in order for Tenant <br /> to obtain such documents, provided, however, that Tenant is diligently pursuing the <br /> issuance of such permits. <br /> 8. Surface Rights of Tenant. Tenant may clear brush and undergrowth from portions <br /> of the Property as may be reasonably necessary to explore for materials, or to locate <br /> pits, quarries and stockpile areas. In order to obtain access to the Property and to <br /> carry on its operations, Tenant shall have the right to use all roadways now existing <br /> on the Property. Tenant may,with the consent ofLandlord,build additional roads for <br /> the production and removal of material. Such consent shall not be unreasonably <br /> withheld. Under no circumstances shall Tenant have access to the Property from <br /> WCR 641/2, <br /> 9. Damage to Water Wells and Improvements. Tenant will repair any physical <br /> damage, created from the mining operation, to water well equipment, gas lines, <br /> storage tanks, water ditches, or the lines. All such repairs shall be completed within <br /> thirty(30)days of written notice from Landlord. In digging pits for the purpose of <br /> producing and removing material, Tenant shall make separate stockpiles of topsoil <br /> and waste substance. Before termination of this Lease, Tenant shall restore the <br /> Property pursuant to its Reclamation Plan. Such Reclamation shall include: <br /> A.
