State of Colorado,has convened a duly and lawfully called <br /> regular itteeting on the 28th day of November, 2016.and: <br /> WHEREAS. The Major Land Use Development Permit Application P DEV 1016-16 for Cargill. Inc.. has been heard by the <br /> YLtma County Planning Commission on November I5th,2016,the Board ofCou•tty Commissioners have received a recommendation <br /> from the Yuma County Plannin_,Commission that this application be approved with stipulations,and: <br /> WHEREAS,The Board of County Commissioners notified the public through a legal notice in the local papers that a Public <br /> Heariniz would take place at 10:00 a.m.on November 28th. 2016, in the C'ommissioneCs office at the Yuma County Courthouse.3110 Ash <br /> Street, Suite A. Wray.CO 80758.and; <br /> WHEREAS. The MlJor i-.and Use Development Permit for Cargill, inc., spas presented to seek a Limited (110) Construction <br /> Material Extraction Operation permit on an existing open pit mine on approximately 10 acres,at the intersection of Co. Rd.44& Co. Rd. <br /> N in the SEi 4 of Section 23. 13N, R47%A'. <br /> NOW,THEREFORE, IT IS HEREBY RESOLVED: The Board of Yuma County, Commissioners have reviewed the <br /> documentation, heard testiniony from the public,and 11611m In`T the hearing held November 28th,2016. voted unanimously to approve the <br /> rcqucst a ith the following conditions: <br /> • The Applicant shall be responsible for complying with all federal,State,and Local regulations,rules,codes,conditions. and <br /> desi_n standards. <br /> • The Applicant shall be responsible for reclaiming the site with NRCS approved seed mixes once the mine has reached the end of <br /> life. <br /> • Should human icinains be discovered during the proposed project activities,the Applicant must tollow the requirements under <br /> Slate l wa CRS 24-80(part 13). <br /> • The Applicant shall comply with the setbacks from the boundaries of the permit site as required by the Yuma County Land Use <br /> Code. <br /> • Minerals from this permit shall be used solely by the applicant aed shall not be for resale. <br /> • Yuma County Board ol'County Commissioners approval of the Cargill Pit is continent upon approval by the State of Colorado <br /> Division of Reclamation, Minina and Safety. <br /> THIS RESOLUTION AND THE DECLARATION MADE HEREIN shall be recorded as a matter of Public Record in the <br /> Office of the Clerk and Recorder of Yuma Count. <br /> .ADOPTED THiS 28th DAY OF NOVEMBER 2016.
