Lynch
Environmental Protection Specialist
Division of Reclamation, Nlining and Safety
1313 Sherman St., Room 215
Denver, Colorado 80203
RECEIVED
MAY 0 4 2017
Division of Reclamation,
Mining & Safety
Re: Foidel Creek Kline (Permit No. C-1982--056), Technical Revision No. 87 (TR -87) Thickener Underflow
Borehole and Pipeline (HC #67400)
Dear Nis. lynch:
Thank you for your recent correspondence dated April 3, 2017 (received by our office on April 7, 2017)
regarding the subject undertaking. We also appreciate the e-mail responses we received on April 19, 2017 and
.\pril 24, 2017 to our request for maps showing the proposed area of additional disturbance.
_\ search of the Colorado Cultural Resource Inventor\, Database indicates that no cultural resource inventories ha\ e
been conducted in the vicinnty of the proposed area of additional disturbance and no cultural resources eligible for
or listed to the National Register of I listoric Places have been recorded therein. Our files contain incomplete
information for this area and there is the possibility that as vet unidentified cultural resources exist within the
proposed permit area.
Because the proposed mining plan amendment involves Federal oversight and proposes additional surface
disturbance outside the area currently approved, please note that it is the responsibility of the Federal
agencies involved to comply with Section 106 of the National IIistoric Preservation Act as set forth in 36
CFR Part 800 ("Protection of Historic Properties"). This includes the identification of any historic
properties (i.e. cultural resources which are eligible to be listed in the National Register of Historic Places)
within the area of potential effects and determining whether the undertaking will have an effect upon such
properties. The State Historic Preservation Office, Native American tribes, representatives of local
governments, and applicants for Federal permits, licenses or other approval are entitled to consultative roles
in this process.
Thank you for the opportunity to comment. If we may be of further assistance, please contact Bob Cronk,
Section 106 Compliance Manager, at (303) 866-1608 or robcrt.cronkt,state.co.us.
Sincerely,
-;lStevc'Turn , :\IL\
State I-Iistoric Preservauon Officer
ST/rc
