ASPHALT
SPECIALTIES CO .
10100 Dallas St. • Henderson, CO 80640 . (303)289-8555 • Fax: (720)289-7707
May 5, 2017
Mr. Eric Scott
Environmental Protection Specialist
Colorado Div. of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, Colorado 80203
RE: Request for Second Extension of Time to Address Partial Adequacy Review Comments for Chavers
Mining Resource DBMS Permit No M-2015-030 AM-I
Dear Mr. Scott:
I am officially requesting that Asphalt Specialties Co., Inc. (ASCI), the applicant for the referenced permit
amendment, be granted a second extension of time to effectively address what appears to be, in my estimation,
only one remaining adequacy review issue from your Dec. 29, 2016 preliminary adequacy review of the
referenced application package. That one remaining issue (please note that adequacy responses to most of the
other issues from that review were responded to in my 3-14-17 extension request letter) is approval from CDOT
to mine within 200 ft. of their erosion control dikes located on the northern edge of the amendment area in the
bank of the South Platte River. ASCI needs to complete an approved slope stability study in order to
accomplish this.
ASCI is requesting another 60-day extension of time from the original decision date of March 16, 2017 to July
1 1, 2017 in order to complete the CDOT approval process. The slope stability analysis has been slow in the
completion of the report and it has yet to be given to CDOT for review and the CDOT review could take some
time to complete.
Please contact me for a confirmation of the new decision date and if there are any questions or concerns you
may have with this request for the added time extension.
Sincerel ,
Rob Laird
Resource Manager
cc: file
