Therefore, if the axounts of nontributary <br /> groundwater de:feed herein are in an insufficient quantity <br /> to replace depletions for the total operation proposed under <br /> this plan for augmentation, Applicant will obtain water fron <br /> anotker source, line the pond or fill in the pond with <br /> onsite backfill materials, if Applicant adds sources Of <br /> replacement water, Applicant trust file an application with <br /> the Water Court seeking approval of an additional source or <br /> sources for replacement of depletions. ire Court retains <br /> jurisdiction Fursuant to paragraph 36 to assure the <br /> continued replacement of depletions. Further, the Court <br /> :-ctains jurisdiction for five years after mining operations <br /> have ceased to ensure that the pond is either lined, filled <br /> in or that the water designated as the replacement source in <br /> this decree is adequate, or an alternative water supply of <br /> augmentation is secured to replace evaporative depletions if <br /> necessary. <br /> 37. Applicant agrees that the requirements of this decree <br /> shall run with the land and be recorded in the real estate <br /> records of Elbert County, Colorado. <br /> 14 <br />
