2. Objector Fontanari Family Revocable Trust ("Fontanari") has made repeated <br />objections to SCC's investigations pursuant to MR -82 and to the TR -69 Application. <br />See Fonatnari's October 27, 2016 "Response to Snowcap Hydrologic Communication <br />Repair Plan"; and Fontanari's February 16, 2017 "Comments to Proposed Decision <br />Approving Snowcap Repair Plan, Demand for Evidentiary Administrative Hearing <br />before ALJ, and Description of Hearing Issues." <br />3. The MLRB's Formal Hearing on TR -69 is set for May 24 and 24, 2017 ("Formal <br />Hearing"). <br />4. Rule 2.6 of the Minerals Rules and Regulations of the Colorado Mined Land <br />Reclamation Board, adopted by the MLRB and its Pre -Hearing Conference Officer <br />for purposes of setting procedural requirements in this matter, required that all <br />exhibits to be submitted by a Party at the Formal Hearing were to be identified and <br />provided to MLRB and the Parties at the Pre -hearing Conference held on April 12, <br />2017. <br />5. At the April 12, 2017 Pre -hearing Conference, Fontanari provided copies of its <br />Exhibits. Among other items, the Fontanari Exhibits contained two previously <br />undisclosed reports and analyses. Those reports included the following: <br />a. Exhibit 24 - Report dated April 11, 2017 by Walter Environmental & <br />Engineering Group, Inc., titled Evaluation of Observed Surface -Deformation <br />Features, Fontanari Property, Cameo, Colorado, consisting of 116 pages with <br />appendices (the "Walter Report"); <br />b. Exhibit 25 - Report dated April 10, 2017 by Grand Valley Consulting, LLC <br />dba Geotechnical Engineering Group, titled Geotechnical Consultation <br />2 <br />
