• To devote necessary time and best efforts on the Property and operation of the <br /> Property in a timely,thorough, and workman-like manner. <br /> • To follow crop and/or tillage practices generally recognized and accepted in the <br /> Property's locality. <br /> • To notify Landlord of any outbreak of noxious weeds so they can be dealt with by <br /> Landlord in a timely fashion. <br /> • To prevent soil or wind erosion and in all respects to care for the Property in such <br /> a manner as to return it to Landlord at the termination of the Agreement in as <br /> good condition as at the beginning of the term,ordinary wear and tear excepted. <br /> • To operate the Property with a reasonable high level of efficiency and appearance. <br /> • To prohibit the dumping of trash and/or the discarding of equipment and/or <br /> supplies on the Property. <br /> • To pay 100% of the costs of repair and maintenance on all irrigation equipment, <br /> including sprinklers, pumps, motors and other auxiliary equipment located on the <br /> Property. <br /> • To pay any and all possessory taxes,if any, assessed against the Property. <br /> LANDLORD'S OBLIGATIONS <br /> Landlord promises and agrees to furnish all the materials and labor and pay all the items <br /> of expense for the following: <br /> • All real estate taxes and assessments for the Property, if any. <br /> • Necessary treatment of noxious weeds on the Property. <br /> MISCELLANEOUS <br /> • Tenant hereby grants to Landlord during the term of this lease a 10 foot access <br /> easement to provide reasonable pedestrian and vehicular ingress and egress to that <br /> parcel described in Book 1016 at Page 732 of the records of Logan County, <br /> Colorado, said easement being more particularly described as follows: <br /> A 10 FOOT ACCESS EASEMENT IN THE SOUTHWEST QUARTER(SW114)OF SECTION 33,TMMHIP 8 NORTH,RANGE 52 WEST OF THE SIXTH PRINCIPAL <br /> MERIDIAN,LOGAN COUNTY,COLORADO,AD EASEMENT BENG 5 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED CENTERLINE: <br /> COMMENCING AT THE NORTWWEST CORNER OF SAID SW114 OF SECTION 33;THENCE SOUTH 214'10'EAST ALONG THE WEST LINE OF SAID SW1/4 OF <br /> SECTION 33 A DISTANCE OF 7164 FEETTO THE TRUE POINTOF BEGINNING;THENCE NORTH 84°5r55'EAST A NSTANCE OF 357.06 FEET;THENCE NORTH <br /> Wi V45'EASTA DISTANCE OF 100239 FEETAND TERMINATING AT A POINT ON THE WEST LINE OF A PARCEL OF LAND DESCRIBED IN BOOK 1016 AT PAGE 732 OF <br /> THE LOGAN COUNTY RECORDS,THE SIDELINES OF SAID EASEMENT TO BE EXTENDED OR SHORTENED TO TERMINATE ON THE WEST LINE OF SAID SW114 AND <br /> THE WEST LINE OF SAID PARCEL OF LAND DESCRIBED IN BOOK 1016 AT PAGE 732 EASEMENT IS SUBJECT TO THE RIGHT-OF-WAY OF EDITH ROAD ALONG THE <br /> WEST LINE OF SAID SWI14OF SECTION 33. — - <br /> ("Access Easement"). <br /> • Landlord promises and agrees to monitor said "Access Easement" and to timely <br /> "close"said Access Easement when it would unreasonably interfere with Tenant's <br /> farming/irrigating in the immediate area. <br /> • Tenant promises and agrees not to unreasonably interfere with said Access <br /> ( Easement. <br /> -2- <br /> 8/30/2016 9:33 AM <br />
