We acknowledge the comments made by History Colorado. No changes appear to be <br /> necessary to the application because of those comments since all mining has already <br /> occurred. <br /> 4. The Division has attached the new Performance Warranty form which is required to be filled <br /> out, notarized, and returned prior to the conversion issuance. <br /> The new Performance Warranty is being signed,notarized, and should be returned directly <br /> by Ritcheys' Redi-Mix Concrete, Inc. prior to the conversion issuance. <br /> EXHIBIT E-Reclamation Plan(Rule 6.4.5): <br /> 5. In accordance with Rule 3.1.6(1),please describe how the site's final configuration will <br /> minimize the disturbance to the prevailing hydrologic balance. The Division is concerned that <br /> the operation has created a diversion of Sandy Creek which may cause flooding to lands located <br /> just northeast of the site. Please describe how stormwater will be allowed to return to the natural <br /> channel of Sandy Creek(i.e. the berm between the creek and the excavation will be removed or <br /> flattened out). <br /> Based on comments previously received at the site visit, Ritcheys' Redi-Mix Concrete,Inc. <br /> has committed to flatten the berm between the creek and the previous excavation. This will <br /> allow stormwater to return to the natural channel of Sandy Creek. If a bank is created in <br /> that process,it will be re-seeded. The flow area will not be seeded. <br /> EXHIBIT F - Reclamation Plan Map(Rule 6.4.6): <br /> 6. The Reclamation Plan Map depicts the new Tract 2 and Tract 3 being entirely mined out, <br /> while current configuration of the site,which is also planned to be the final configuration, is <br /> limited to only the southern portion of Tract 2 and the southwest portion of Tract 3. Since this <br /> Conversion Application references"reclamation-only",please submit a new Reclamation Plan <br /> Map,pursuant to Rule 6.4.6(a),which accurately reflects the physical appearance of the <br /> reclaimed affected lands. <br /> A revised final contour map has been prepared and is submitted. A Google map of the <br /> area is also attached. It shows that there are large areas of trees within the boundaries that <br /> have been left intact. <br />
