Exhibit H—Wildlife Information <br /> • Any modifications of the current fencing requirements to address Colorado Parks and <br /> Wildlife concerns <br /> CC&Vs response: <br /> Considering both operational and closure scenarios, CC&V has evaluated multiple fencing <br /> designs. This evaluation determined that whilst many designs could achieve multiple objectives, <br /> some designs are more effective than others. As an example 8 foot wire mesh fence may provide <br /> greater protection to wildlife access, however is far less effective at preventing public access. <br /> CC&V also considered the practicalities of multiple and/or varying fence designs and <br /> applications and determined that this was not a viable option. <br /> As a result, CC&V have determined that the 6 foot high chain link fence is the most functional <br /> and effective design to address the purposes of both operational security and public access, <br /> whilst deterring wildlife from encroaching open pit high walls. <br /> This design remains consistent with that currently proposed within CC&V closure planning <br /> documents. <br /> 40f. Exhibit H—Wildlife Information <br /> • Adjustments to the financial warranty associated with any changes to the wildlife <br /> protection plan including, but not limited to, installation, maintenance, and removal of <br /> wildlife protection measures. <br /> CC&V's response: Based on CC&V's determination that no changes are required to the current <br /> fencing design, no changes are required to the approved financial warranty. <br /> Summary <br /> This letter is intended to start the dialogue required between CC&V, DRMS, and CPW to reach <br /> an agreement regarding wildlife fencing within the 120 day timeframe. <br /> In summary, CC&V considers that the lack of data related to wildlife interactions with open pit high walls <br /> demonstrates the risk to the CC&V operations is negligible and well managed. <br /> Considering this demonstration,coupled with the reasonable likelihood for further mine growth and/or <br /> expansions, CC&V believe that no change to the current management approach is required.
