On December 2, <br />2016, GCC Energy, LLC (GCC) filed an application to renew King II Mine Permit CO -0106A. <br />This application was filed with the Office of Surface Mining Reclamation and Enforcement <br />(OSMRE) in accordance with the requirements of the implementing regulations of the Surface <br />Mining Control and Reclamation Act (SMCRA.) As required by regulation 30 CFR 774.15, the <br />application was filed with OSMRE at least 120 days prior to the April 17, 2017, permit term <br />expiration date. <br />On January 31, 2017, following completion of our initial review of the permit renewal <br />application, OSMRE notified GCC that the renewal application was Administratively Complete; <br />however, requested the public notice include both the 2017 renewal application and <br />announcement of a proposed permit revision. OSMRE provided the request in an effort to <br />communicate with the public clearly and efficiently. Announcement of the 2017 permit renewal <br />application and significant permit revision application were initiated on March 27, 2017; and <br />materials made publically available for review and comment. <br />GCC is completing an update to the permit application to include additional information on <br />hydrologic characterization, subsidence, vegetation, cultural resources, and performance bond. <br />We consider the additional information to be important and relevant in helping us make our <br />decision on the 2017 GCC renewal application.
