MR83: Approved November 2, 2016, MR83 approved reduction of sediment pond capacity <br />surveys. <br />Technical Revisions <br />TR80: Approved September 16, 2013. TR -80 approved the installation of three (3) culverts to <br />promote better efficiency to the drainage network. <br />TR81: Approved November 5, 2013. TR81 approved a reduction of $437,096.61 to the <br />reclamation liability bond due to MT6 review. <br />TR82: Approved October 6, 2016. TR82 approved revising the method for collecting flow data <br />for surface water monitoring, eliminating monitoring of an alluvial well, and eliminating <br />monitoring of an inactivated water supply well. <br />Surety Releases <br />SL4: Partially Approved December 19, 2013. The Division partially approved Seneca Coal <br />Company's Phase I bond release on 127.65 acres, and reduced the required liability by <br />$801,465.00. <br />SL5: Partially Approved August 27, 2014. SL5 approved a partial Phase II bond release of 800.8 <br />acres, and reduced the required liability by $87,927.00. <br />Other Revision Types <br />SO2: Approved February 11, 2016. SO2 approved Seneca Coal Company LLC name change of <br />the permittee to Seneca Property LLC. <br />Status of Stipulations <br />The stipulation history for the (site name) was reviewed with this renewal application. The review <br />included an investigation of any stipulations imposed, and any responses to existing stipulations <br />received since the last midterm review. Any stipulations associated with this permit and issued <br />over the life of this operation which are not discussed have been complied with or terminated. <br />There is one stipulation still attached to the permit. Stipulation No. 39 was attached to the permit <br />with the approval of Technical Revision No. 77 (Approved April 8, 2013). Stipulation No. 39 <br />states: <br />DIVISION APPROVAL OF PERMANENT RETENTION OF PONDS 006, 009, 015, 016, AND <br />017 IS CONDITIONED UPON THE APPROVAL OF THEIR RETENTION BY THE STATE <br />ENGINEER. DOCUMENTATION OF OFFICE OF STATE ENGINEER APPROVAL OF <br />PONDS 006, 009, 015, 016, AND 017 AS PERMANENT IMPOUNDMENTS, ALONG WITH <br />DOCUMENTATION THAT ANY NECESSARY WATER RIGHTS HAVE BEEN OBTAINED <br />FOR THE IMPOUNDMENTS, SHALL BE PROVIDED TO THE DIVISION PRIOR TO <br />APPROVAL OF ANY BOND RELEASE APPLICATION FOR THE IMPOUNDMENTS. <br />This stipulation has been partially complied with. SP still needs to submit Colorado State <br />Engineer's Office approval for Pond 006, Pond 016, Pond 017, and Stock tank T-22. <br />iii <br />
