BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF THE APPLICATION OF PARKERSON CONSTRUCTION, VC. ICOR A 112c <br />CONSTRUCTION MATERIALS RECLAMATION PERMIT, File No. M -2016 -OS) <br />THIS MATTER came before the Mined Land Reclamation Board ("B'ard") on March <br />22, 2017 in Denver for a hearing to consider the application for a 112c con ction <br />materials reciametirotr permit Bled by Parkerson-Construetiorri Inc ("Appli nt"), file <br />number M-2016-050. Stephanie Mitchell and Russ Means appeared on be'lalfof the <br />Division of Reclamation, Mining and Safety CDivision"). Alan Parkerson apeared an <br />behalf of Applicant: Objector Alane Wooster appeared via telephone on heT own behalf. <br />The Board, having considered the presentations, testimony, and evi' ence of the <br />Division'; Applicant; and the objector, and being otherwise fully informed f the facts In the <br />matter, enters the following. <br />FINDINGS OF FACT <br />1. On September 13, 2016, the Applicant filed an application with the Division <br />for a 112c reclamation permit under section 34-32.5-112, C.R.S, for a sit:ass'Application!3, own as the C <br />Road Pitt file number M-2016-050 (the application is referred to herein <br />located. in section 12, Township 1 North, Range 1 East, Ute Principal Men in Mesa <br />County, Colorado. I <br />2. During the public comment period, as mandated by Rule 1.7.1 of the Mineral <br />Rules and Regulations of the ColoradoMined Land Reclamation Board for he Extraction of <br />Constructian4Materials, 2 CCR 407-4 ("Rules"), the Oivision received a timi ly letter of <br />abjection from Robert aad Alane Weester, ar}daoomentleums from Histc ryColorado and <br />the Colorado Division of Water Resources. <br />3. During the review period, the Division generated two adequ'cy letters <br />between. The Applicant addressed all of the Division's adequacy Issues to Division's <br />satisfaction. <br />4.
