Objectors' geological and engineering consultants need access to the original ERT <br />data collected by Fugro Consultants in the April and August, 2016, field testing. Working with <br />Xerox copies of the same leads to inaccurate analysis. Objectors request that the original data be <br />provided to Mr. Ken Walter and Mr. John Withers on or before May 1, 2017. <br />3. Objectors' water engineer, Mr. Fox, also needs the flow, discharge and water <br />transmission rates for Outlet 016 and the portal of the South Portal Mine for the period January <br />1, 2014 through and including May 15, 2017. <br />4. Subpoenas: Should any party need a subpoena to guarantee the availability of <br />any witness at the May 24, 2017, hearing, then the PCHO shall issue such subpoena upon request <br />of that party's counsel. The requesting party shall, simultaneous with the request, provide to all <br />opposing parties and their counsel copies of both the request and the issued subpoena. Failure to <br />copy all opposing parties and counsel simultaneously with requesting the subpoenas shall <br />invalidate any subpoena issued by the PCHO. <br />VII. HEARING EFFICIENCIES <br />The formal hearing is set for one day: May 24, 2017, in Denver, Colorado. Objectors <br />deem the hearing time and its location to be troublesome and inconvenient. As shown above, <br />90% or more of all witnesses, parties and counsel are based in the Grand Junction, CO, area. To <br />prevent excess expense and promote convenience to the witnesses, Objectors propose the <br />following: <br />A. All parties will stipulate that Exhibits 1-13 are admissible and relevant without the <br />necessity of authentication testimony. The statements made in these exhibits may be used for <br />any evidentiary purpose desired by a party. <br />B. Any party may supplement Exhibits 1-13 with additional information so long as <br />the party provides to all opposing counsel a copy of the proposed supplement (including any <br />expert reports; testing data; etc.) with production to opposing counsel occurring on or before <br />May 1, 2017. <br />C. The hearing on TR -69 should be conducted in Grand Junction, Colorado. <br />D. All parties would stipulate that the Board's decision may be rendered within one <br />week after conclusion of the hearing. (This is deemed necessary to accommodate the Board <br />returning to Denver from Grand Junction for other hearings on May 25, 2017). <br />8 <br />
