COLORADO
Division of Reclamation,
Mining and Safety
Department of Natural Resources
1313 Sherman Street, Room 215
Denver,Colorado 80203
March 24, 2017
Andy Rodriguez
Civil Resources LLC
323 5"St
Frederick CO 80530
Re: North LaPoudre Pit,Permit M2000-144,Receipt of Incomplete 112 Construction Materials
Reclamation Permit Amendment Application Package
Mr. Rodriguez:
On March 20,2017,the Division of Reclamation,Mining and Safety received the 112 Construction Materials
Reclamation Permit Application package for the North LaPoudre Pit(M2000-144). Preliminary review of the
information received determined that the following items must be received before the Division can consider your
application as being filed and technical review can begin:
APPLICATION FORM:
Lines 1.1 and 5.2 were left blank, and the"Applicant/operator or company name"given on line 1 does not match
that used on the signature page(page 8).
EXHIBITS:
Exhibits Q, and R are missing from the submittal.
Exhibit S is incomplete as no proof has been provided that damage waiver agreements were provided to any of the
listed structure owners within 200 feet of the permit as required by Rule 6.4.19(a).
DRMS is required to process amendments to existing applications in accordance with Rule 1.10.1(4)which states
that"Applications for amendments shall be reviewed by the Board or Office in the same manner as applications for
new Permits."
Rule 1.10.1(1)also states that"Where applicable, there shall be filed with any application for a 112 Reclamation
Permit amendment, attachment(s)map(s)and one(1)original and four(4)copies of the application with the same
content as required for an original application, except that the Applicant will not be required to submit any
information which duplicates applicable previous submittals. However, the Applicant shall clearly describe where in
the original application and supporting documents the information not included in the amendment application, but
necessary to render the amendment technically adequate, may be found. Generally speaking, with a 17-year-old
permit such as this, a new/revised set of all required exhibits, especially maps, will be the easiest way to provide
sufficient information to DRMS. DRMS will require sufficient information to review the whole of the proposed
permit area before this amendment can be approved.
Bestway Concrete will also be required to submit a new performance warranty for this amendment to be considered
complete for filing.
OF COLD
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us
John W.
