applicant spade 6"and 8" diameter trees transport and plant 35 trees to be provided by <br />this land owner. The trees shall be planted primarily on the southern facing slope of the <br />berm on a "to -be -determined" spacing. Applicant would also be responsible for any <br />permitting that might be required. <br />L. Necessary Mitigation: This land owners property is elevated 14 feet above the <br />proposed mine and is flanked by the mine for a quarter of a mile (1,468 If). To mitigate <br />both the dangerous health condition and visual impacts this land owner requires that an <br />earthen berm be constructed along the Windell's northern property border with the <br />mine. <br />L The berm would be constructed of pit run topped with 18 inches of top soil. The <br />height of the berm would be 16 feet in elevation on the northwest corner and <br />progress to 32 feet in elevation to the east where an existing driveway exists the <br />property. <br />ii. East of the drive the berm would be 16 feet tall and progress to the east end at <br />the intersection of Weld County Road 22 %: and Weld County Road 25 The north <br />face of the berm would be terraced and benched at a 2:1 slope while the South <br />facing slope would be 3:1. <br />iii. The berm shall be covered with biodegradable straw mulch erosion control <br />fabric. <br />iv. The entire berm must be seeded ata rate of 65 PLS/acre with chewing fescue, <br />Festuca rubra ssp. Commutata would be necessary and 90% coverage required. <br />Reseeding shall occur until non erosive slopes area created. <br />v. In addition, the applicant shall purchase and install 50 Blue Spruce trees of not <br />less than 15' tall 6"and 8" caliper, trees approved by the Windells, <br />vi. The trees shall be planted primarily on the southern facing slope of the berm on <br />a "to -be -determined" spacing. <br />vii. Trees shall be maintained and or replaced by the applicant until establishment a <br />period of 18 months, <br />Additionally, the applicant has proposes a denuded aggregate mine. The applicant has <br />given zero thought to the environmental conditions at the site or the consequences to adjoining <br />living human beings. <br />Conclusion: These land owners object to the visual impacts of the applicant's location of the Processing <br />Plant Area and the Asphalt/Concrete Batching Plant Area and ask that the permit be denied until <br />alternative opportunities and constraints are adequately examined and the health consequences <br />assigned a trigger point and compensatory damaged calculation. <br />V. Objection to Noise Impacts: <br />A. Background: For 25 years we have heard and listening to sounds of wildlife such as <br />geese, eagles, turkeys, pheasants, hawks, coyotes and many species of birds. The <br />Applicants proposed mine like others in the region will be "Noisy". Back up warning <br />signals can be heard locally for 12 hours a day. The impact of the noisy mining <br />enterprise adjacent to the Windell's is objectionable and unacceptable. <br />
