Hynes-Windell Trust and Bradley T. Windell Trust Assessors I.D. No. 131112400035 & <br />131112400036, Adjacent to Applicants Proposed Construction Materials Operation and Respectfully <br />Request Modification of that Application and to Avoid 25 Years of Long Term Exposure to Lung <br />Damaging Inhalants. <br />Dear Mr. Peter Hays, <br />Environmental Protection Specialist & <br />Mined Land Reclamation Board <br />Please find listed below objections related to the applicant Northern Colorado Constructors Inc (NCCI), <br />Application for a Construction Materials Regular (112) Operation Reclamation Permit and the impacts on <br />the adjacent land owners Heidi G. Hynes-Windell Trust and Bradley T. Windell Trust Assessors I.D. No. <br />131112400035 & 131112400036. <br />I. Objection to Asphalt/Concrete Batch Plant Area: For 25 years these land owner have lived <br />peacefully in this rural agricultural area enjoying vegetable farming, animal husbandry, <br />wildlife and fresh air. The applicants proposed location of its Asphalt / Concrete Batch Plant <br />Area is objectionable and unacceptable to these adjacent property owners sharing a quarter <br />of a mile property line. We object for the following reasons: <br />A. Objection to Asphalt Batch Plant Area: For more than 25 years the area has been <br />agricultural and has not been zoned industrial and requiring the need for an Air <br />Pollution Emission Notice (APEN). <br />i. The operation of an asphalt plant causes the emissions of many different pollutants <br />and given the adjacent land owners are located in the north and north by <br />northwest prevailing winds will carry these emissions in our families lungs and our <br />family farm air space is unacceptable, <br />ii. The most common pollutant emitted from an asphalt batching plant is: <br />iii. Sulfur dioxide (SO2), that irritates the skin and mucus membranes of the nose <br />throat, and lungs. In high concentrations causes respiratory lung tissue <br />inflammation and irritation resulting in symptoms of pain when taking a deep <br />breath, causing coughing, throat irritation and breathing difficulties.
