If other plans are developed and implemented in the future <br /> by the City/County it should clearly be stated that they do so at their own risk and expense at that the <br /> Division would not be encumbered by such repurposing. <br /> To restate the steps necessary to achieve the preservation on the Pandora Mill and release from the permit <br /> area,the following will need to occur: <br /> 1. A Phase 1 Environmental Assessment must be completed and submitted to the Division. <br /> 2. Review and analysis of remediation techniques to determine if acceptable levels for lead inside and <br /> outside of the Mill can be reasonably achieved. <br /> 3. Submittal and approval of an amendment to change the post mine land use for this area of the <br /> DRMS permit from wildlife habitat to historic tourism. The amendment shall also include: <br /> a) Information that addresses the method of remediation of the mill interior to an agreed upon <br /> lead limit and include safeguarding to prevent reasonable public access. <br /> b) Identification of auxiliary structures to be preserved and safeguarded to prevent reasonable <br /> public access. <br /> c) New maps that clearly delineate affected lands or structures that will be released and <br /> affected lands or structures that will remain within the permit boundaries. <br /> d) Documentation of an agreement between Newmont and the City of Telluride and/or San <br /> Miguel County for transfer of ownership of the Mill for historical viewing purposes. <br /> e) Documentation of acceptance of financial responsibility by the City/County for perpetual <br /> maintenance. <br /> f) A general plan from City/County for monitoring and maintenance of the Mill. <br /> g) A clear statement from the City/County that any future repurposing would be done at <br /> City/County expense and would not encumber the State. <br /> If these steps can be completedthe Division believes that the public health and environment can be protected <br /> while allowing the historic mill to be preserved for future historic reference.
