Dear Mr. Brubaker:
On March 13,2017 the Division of Reclamation,Mining and Safety approved the succession of operators
from VALCO,Inc.to South Forty Recreation,LLC for this operation,pending receipt and approval of the
required financial warranty. On March 30,2017 the Division received and approved the financial warranty
provided by South Forty Recreation,LLC. South Forty Recreation,LLC is now the permitted operator of
the Canon City East Pit, and as such, is responsible for all provisions in M-1977-559, as well as those
specified in the Rules and Regulations.
Enclosed are the following bond and the Performance Warranty you originally provided.

These have been released as of the March 30, 2017 Division's final approval for the succession of
