Bowles <br />I?nvironmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RECEIVED <br />MAR 3 0 2017 <br />Divisimof RerJaM 011, <br />Ljinkv & Safety <br />Re: New I Iorizon North Mine 'Technical Revision No. 15 — Revises the Postmining Topography (Permit No. 0- <br />2010-089) (1 IC # 67}60) <br />Dear Mr. Bowles: <br />We received your correspondence dated March 13, 2017 on March 17, 2017, initiating consultation with our <br />office under Section 106 of the National Historic Preservation Act (36 CFR 800) and in accordance with the <br />May 1991 Memorandum of Understanding between our offices for the above referenced permitting activities. <br />After review of the documentation provided to our office and the permit application records available on \,our <br />website, we believe that a finding of no historic properties affected [36 CFR 800.4 (d) (1)] is appropriate for the <br />above referenced activities. <br />Should unidentified archaeological resources be discovered in the course of the project, work must be <br />interrupted until the resources have been evaluated in terms of the National Register eligibility criteria (36 <br />(TR 60.4) in consultation with our office pursuant to 36 CFR 800.13. Also, should the consulted -upon <br />scope of the work change please contact our office for continued consultation under 36 CFR 800. <br />We request being involved in the consultation process with the local government, which as stipulated in 36 <br />CTR 800.3 is required to be notified of the undertaking, and with other consulting parties. Additional <br />information provided b\, the local government or consulting parties might cause our office to re-evaluate our <br />ciigibilit\ and potential effect tindings. Please note that our compliance letter docs not end the 30 -day rc\'te\ti <br />period provided to other consulting parties. <br />We thank you for the opportunity to comment.
