ME
Mr. Brock Bowles
March 27, 2017
Page 3
2. DRMS notes on page 4, the Alternative Water Supplies section states that 23 shares of water are
secured, while the current April 2011 version states that 27 shares are secured. Please advise DRMS
if indeed the shares secured were reduced from 27 in 2011 to 23 in 2017.
Response: The Alternative Water Supplies section has been revised to indicate that ERMR has
secured 27 shares of water, which is consistent with the current 2011 version.
Section 4.18 — Protection of Fish and Wildlife
1. Section 2.05.6(2) includes a mitigation plan to the impact of mining on Burrowing Owls and
identifies additional impacts to other species and wetlands. Depending on the response to the above
mentioned adequacy comment associated with Rule 2.04. 11 and 2.05.6(2), additional mitigation
measures may be required. If the T&E species list has changed, please provide an updated mitigation
plan to address the protection offish and wildlife.
Response: Since the T&E species list in Appendix 2.05.6(2)-1 has not changed as part of this renewal
application; no changes to the mitigation plans addressing protection of fish and wildlife should be
required.
Also included with this adequacy response package are materials revised in response to your adequacy
comments and a change of index sheet to ease incorporation of this material into the permit document. If
you have any questions regarding the enclosed adequacy review responses, please contact Tony Tennyson
at (970) 824-1232 or ttennyson;d)tristategt.org.
Sincerely,
d
Daniel J.
