As of the date of this stipulation, Board has not yet provided the parties with confirmation of <br />a firm setting date for the hearing on the Fontanari and Carey objections to the Proposed <br />Decision required by C.R.S. §34-33-116(4) and 2 CCR 407-2:2.08.4(6)(b)(iii), as <br />exemplified by the published agenda for the Board's March 22-23 meeting. Nor have the <br />Request for Clarification by Fontanari and the requests for an ALJ by Carey and Fontanari <br />been resolved by the Board. <br />9. SCC, Fontanari, and Carey, wishing to avoid unnecessary expense of preparation for a <br />hearing that the Board may schedule for a date other than March 22-23, and awaiting further <br />clarification concerning the procedural process before the Board, agree that the hearing on <br />the Fontanari and Carey objections to the Proposed Decision should not be held at the <br />Board's March 22-23 meeting. <br />10. SCC, Fontanari and Carey remain free make their respective arguments to the Board <br />concerning the appropriate scheduling of the hearing on the Fontanari and Carey objections <br />to the Proposed Decision for later dates, the earliest of which would be the April 26-27, 2017 <br />Board meeting. <br />11.
