Mitchell <br />Division of Reclamation, Mining & Safety <br />1333 Sherman St, Suite 215 <br />Denver, CO 80203 <br />RE: Permit Holder: Western Slope Flagstone Quarry #2 <br />Permit No.: M-1996-076 <br />Application: Technical Revision <br />Dear Ms. Mitchell: <br />5460 WARD Rowe, SurrE 120 <br />ARVADA, CO 80002 <br />I am the Operator's Representative for Western Slope Flagstone, Inc., holder of Permit <br />M-1996-076, which operations are situated in Sec. 35, T10S, R98W, 61' P.M., in Mesa County <br />Colorado. Pursuant to Rule 1.8.4, DRMS Mineral Rules and Regulations (August, 2006), <br />Western Slope Flagstone submits its Request for a Technical Revision to their Permit as set forth <br />herein. <br />FACTUAL BACKGROUND <br />Western Slope Flagstone ("WSF") conducts ruining operations within a 39+ acre parcel <br />of land situated in Mesa County, and referred to as Assessor's Parcel N. 2709-34400-070 (Tract <br />#70). Tract #70 is owned by Rudy and Carol Fontanari, Trustees, of the Fontanari Family <br />Revocable Trust ("Fontanari Trust"). <br />For more than four decades, Public Service Company (PSCo) has had two sets of high <br />voltage lines traversing Tract #70. As relevant here, PSCo's Line #1 runs in a north -south <br />direction, commencing at the former site of PSCo's power generation plant located at Cameo, <br />CO. The easement for Line #1 Line has been 25 ft in width. In November, 2015, PSCo <br />approached WSF with a request to widen the easement to 50, to allow for installation of a second <br />set of power poles adjacent to the original set. After installing such second set, PSCo would then <br />move the high voltage line from the original power poles to the new power poles. 1 <br />1 PSCo also has a high voltage line running laterally (NW/SE) across Tract #70. Borings were not <br />conducted along this second lint and, therefore, this second line is not discussed in this application. Line <br />#1 does extend into Fontanari Tract #71 (Parcel No. 2709-344-00-071) but Tract #71 tics outside the <br />Permit boundaries and is therefore note discussed in this application. <br />
