UPDATED <br /> MAP ATTACHED: yes <br /> It is very important to note that significant problems with this operation exist. Most of <br /> those problems are a result of the land being in receivership after the death of the <br /> landowner and permittee. The land will soon be auctioned to a new owner. Schmidt <br /> Construction is currently operating the pit under a still active lease, but Schmidt is <br /> not the permittee. At this time it is not known what will happen to the operation after <br /> the land is sold. Clearly, the law requires that the reclamation obligation continues, <br /> even with change of ownership. Exactly, how this will be worked out is unknown at <br /> this time. However, water issues and bonding are currently the priority and these are <br /> being worked on and hopefully will soon be brought to a suitable conclusion. The <br /> Division is actively involved in all of this. Amy Eschberger and Peter Hunt are <br /> currently working on these matters with the other parties involved. <br />
