Public Notice

The Division of Reclamation, Mining and Safety, in accordance with Title 34, Article 33, of the
Colorado Revised Statutes, hereby issues notice that on March 16, 2017, a minor revision application
(MR-306) to the Foidel Creek Mine, Permit No. C-1982-056, operated by Twentymile Coal, LLC,
29515 Routt County Road No. 27, Oak Creek, CO 80467 was considered complete for the purposes of
filing. The revision is to address water observed at the 9-Right and 10-Right seals. This water is
considered to be coming from the thickener underflow discharge in 8-Right due to a blockage in the
area of 8-Right . This revision proposes to shift the thickener underflow discharge to another location.
The proposed locations include: 1) A temporary measure to shift discharge to exisiting approved 1MN
Replacement Thickener Underflow Borehole. 2) As a backup plan, a previously approved basin
adjacent to Area 1 Pit be re-excavated. 3) As a long-term solution, converting the approved test
borehole at the Sandstone Sub Borehole location to a thickener underflow borehole and install a
connecting pipeline extending 1200’ from the exisiting thickener underflow pipeline at the 1MN
Borehole to the Sandstone Sub Borehole location (3SW Gateroad). The applicant is not proposing
additional surface disturbance outside of the area currently approved for disturbance. All reviews and
comment periods as provided in the Act and Regulations promulgated thereunder initiate from this date
of filing.

Posted March 16, 2017

C-MR-03
