(ASCI), the applicant for the referenced permit, be <br />granted an extension of time to effectively address what appears to be, in my estimation, only one remaining <br />adequacy review issue from your Dec. 29, 2016 preliminary adequacy review of the referenced application <br />package. That one remaining issue (please note the adequacy responses to most of the issues below) is approval <br />from CDOT to mine within 200 ft. of their erosion control dikes located on the northern edge of the amendment <br />area in the bank of the South Platte River. ASCI needs to complete an approved slope stability study in order to <br />accomplish this. <br />ASCI is requesting a 60 -day extension of time from the original decision date of March 16, 2017 to May 12, <br />2017 in order to complete the CDOT approval process. Any deficiencies in the responses given below can also <br />be potentially rectified in this time period as well. <br />RESPONSES TO 12-29-2016 ADEQUACY REVIEW OF THE 112 AMENDMENT APPLICATION FOR <br />CHAVERS MINING RESOURCE AM -1: <br />APPLICATION FORM: A revised application page of the form is included with this correspondence. The <br />original application page of the form was prepared some time before the mapping exhibits were prepared, hence <br />the discrepancy. Also included is a revised Exhibit C-1 showing 95 acres in the permit area. All documents now <br />reflect a consistent permit acreage of 95 acres. <br />EXHIBIT H (WILDLIFE): Included with this correspondence is the complete USFWS PMJM letter from Oct. <br />20, 2015. You will note that the map provided with the USFWS letter also includes the amendment area as <br />being clear of PMJM occurrence. <br />EXHIBIT L (RECLAMATION COSTS): The finalization of this Exhibit will be completed by the applicant <br />and the DRMS at the close of the adequacy review period. <br />
