(Tri-State), is the parent company to Axial <br />Basin Coal Company, which is the general partner to Colowyo Coal Company L.P. (Colowyo). Therefore, <br />Tri-State on behalf of Colowyo is notifying you that Colowyo is submitting an application for Phase I I and III <br />performance bond release on areas reclaimed from 1993 to 1999. This application for Phase I I and I II release, <br />when submitted, will be denoted as SL -12. <br />A Phase II bond release application focuses on vegetative cover and species composition in support of <br />the post mine land use. Further, a Phase 11 evaluation demonstrates the contribution of suspended solids to <br />streamflow or runoff is not in excess of pre -mining levels or levels documented for comparable non -mined <br />areas. Finally, the Phase 11 application demonstrates that topsoil depths are in compliance with the approved <br />mining permit. <br />A Phase III bond release evaluation demonstrates achievement of Phase I and Phase II bond release, a <br />minimum of five (5) years since the last seeding and rill and gully repair, and the reclamation parcels have met <br />the requirements of the revegetation success criteria for two years. <br />This written notice is sent to you pursuant to Colorado Division of Reclamation, Mining and Safety <br />(CDRMS) Rule 3.03.2(1). Prior to filing a request for the bond release, Colowyo must send written notices in <br />accordance Rule 3.03.2(1), of intention to seek bond release. Additionally for your convenience, enclosed <br />please find a copy of the Public Notice which will be published in the Craig Daily Press and Rio Blanco <br />Herald Times in the near future. <br />If you should have any questions regarding this notice for bond release application, please contact <br />Tony Tennyson at you convenience at (970) 824-1232. <br />Sincerely, <br />Daniel J.
