South Platte Combined Replacement Plan <br />March 1, 2017 <br />Page 7 of 19 <br />The dry -up locations for the subject Whitney Ditch shares were originally identified through <br />an April 12, 2011 letter to the Division 1 Engineer. That letter stated the northern portion of Orr <br />Farm #1 may continue to be irrigated using 1 of the 13.5 Whitney Ditch shares owned by the <br />Applicant. In 2011 the entire Orr Ditch Farm #1 was removed from irrigation due to damage to the <br />lateral serving the property. Therefore the entire farm is included as a dry -up location for all 13.5 <br />shares dedicated to the plan in 2017. The share dedication dated February 29, 2012 remains valid <br />and is attached. <br />L.G. Everist Lease <br />Aggregate has entered into a lease with L.G. Everist, Inc. for up to 32 acre-feet of storage <br />water from the Everist Star Reservoir (WDID 0303325). A copy of the agreement is attached. Everist <br />Star Reservoir is part of the Feit Gravel Pit (M-1977-522), and is primarily located in the SEI/a of the <br />SW1/a and the SWI/a of the SEI/4 of Section 26, Township 6 North, Range 66 West, 6th P.M., adjacent to <br />the Cache la Poudre River. The slurry wall liner for the Everist Star Reservoir was approved as having <br />been lined to the design standard referenced in the August 1999 State Engineer Guidelines for Lining <br />Criteria for Gravel Pits in a letter dated December 16, 2014 (amended March 6, 2015) and it is <br />therefore classified as a lined reservoir. Deliveries from the Everist Star Reservoir will be to the <br />Cache la Poudre River via a submersible pump. Aggregate anticipates utilizing 9.70 acre-feet in April <br />2017 and 19.30 acre-feet in October 2017. <br />The headgate for the Greeley No. 3 Ditch is located between the point of depletion of the <br />W.W. Farms Pit and the Everist Star Reservoir (downstream point of release). During times when the <br />Greeley No. 3 Canal is calling for water, Aggregate is not permitted to use the water released from <br />the Everist Star Reservoir as a replacement source for depletions from the W.W. Farms Pit. If <br />Aggregate's Whitney Ditch shares are insufficient or unable to replace depletions associated with the <br />W.W. Farms Pit above the Greeley No. 3 Canal when it is calling, Aggregate is required to make <br />replacements above the headgate for the Greeley No. 3 Ditch by trucking water from the Everist Star <br />Reservoir or otherwise acquiring an alternate replacement source. <br />St. Vrain River <br />Martin Marietta Lease <br />Aggregate has entered into a water lease agreement with Martin Marietta Materials, Inc. for <br />13.0 acre-feet of fully consumable water stored in Heaton Reservoir (WDID 0504089). A copy of the <br />lease agreement, dated December 20, 2016, is attached. Heaton Reservoir is part of the Hamm Pit <br />(M-1987-176), and is located in the NYz of the NE' of Section 9, Township 2 North, Range 68 West, <br />6'h P.M., adjacent to the confluence of Boulder Creek with St. Vrain Creek. There are no intervening <br />water rights between the Distel and Tull Pits (upstream points of depletion) and the Heaton <br />Reservoir (downstream point of release). The slurry wall liner for the Heaton Reservoir was <br />approved as having been lined to the design standard referenced in the August 1999 State Engineer <br />Guidelines for Lining Criteria for Gravel Pits in a letter dated April 7, 2003 and it is therefore <br />classified as a lined reservoir.
