Carey requests that the Division Of Reclamation Mining and Safety (i) reject and <br />dismiss, in its entirety, the Hydrologic Repair Plan proposed by Snowcap Coal <br />Company, Permit No. C1981041; (ii) that this Division adopt, in toto, the Repair <br />Plan proposed by the Fontanari Group, including the award and payment of <br />attorney fees incurred Carey; and (iii) pursuant to C.R.S. §24-4-105, Carey <br />demands an evidentiary hearing in this matter to be conducted by an <br />Administrative Law Judge assigned from outside the DRMS. <br />Respectfully submitted, <br />R �7,zegfa-zV Staty <br />R.
