6. Further Assurances. The parties agree to prepare and execute such other and additional
documents and instruments to carry out the intentions of the parties under this Agreement.
Notwithstanding the preparation and execution of such other instruments,the parties acknowledge and
agree that this Agreement is legally binding on each party and its successors and assigns.
7. Notices. All notices under this Agreement shall be sent by certified U.S. Mail to the
addresses listed below, or at such other address as a party may subsequently designate in writing. A
party shall also, in addition, send notice or other correspondence by electronic mail to the listed
accounts.

8. Authority. The persons signing this Agreement on behalf of each party represent and
warrant that they have the authority to do so,and each party represents it has proper authority to enter
into this Agreement. The terms of this Agreement may only be modified in writing signed by all parties,
and no party shall be deemed to have waived any of its rights under this agreement absent a writing
signed by the party against whom such waiver is asserted which expressly waives such right.
9. No Waiver—Gold. Nothing in this agreement shall be construed to constitute a waiver
of any claims Anadarko may have to the right to extract and sell gold from the Southwest Quarter of
Section 20, T1N-R 66W where Anadarko owns the minerals, and this agreement is not intended to
impact any title issue one way or another as to such minerals.
10. Binding Nature of This Agreement. The covenants and terms hereof shall run with the
land and inure to the benefit of and be binding on the parties and their respective successors and
assigns.
