February 16, 2017 C-1981-012/New Elk Mine BFB <br /> <br /> <br />Number of Partial Inspection this Fiscal Year: 7 <br />Number of Complete Inspections this Fiscal Year: 2 <br /> <br /> Page 3 of 7 <br /> <br /> <br />Equipment at Pond 007A indicated that NECC is still removing sediment from this pond. The material can be seen <br />at the clean coal storage area, which is where (in a previous inspection) Vince Massarotti said the material would <br />be temporarily placed for drying. <br /> <br />Containment Area #5 was holding water, but it was below the top of the structure, and there was no sign of <br />discharge toward State Highway 12. No signs of discharge were seen out of Containment Areas 3 and 4 (they were <br />empty), and no problems were detected with these structures. <br /> <br /> <br />GENERAL MINE PLAN COMPLIANCE: <br />An inspection of the banks along the Middle Fork of the Purgatoire River did not indicate that the New Elk Mine <br />has recently caused erosion or other significant problems to this waterway. <br /> <br />PROCESSING WASTE/COAL MINE WASTE PILES – Rule 4.10 and 4.11 <br />Drainage Control; Surface Stabilization; Placement: <br />Minor erosion was seen on the face of the lower RDA (reclaimed portion). There is possible erosion in the eastern <br />side ditch. These issues are on the NECC maintenance list per Vince Massarotti. The ditch and other surface water <br />control structures (namely sumps) between the upper RDA and lower RDA appears to be functioning well. No <br />problems were seen with the upper (un-reclaimed) portion of the RDA. <br /> <br />SUPPORT FACILITIES - Rule 4.04: <br />No problems were seen with the soil storage area, the coal storage areas, the retaining wall above the fan, or other <br />facilities. <br /> <br /> <br /> <br /> <br />ENFORCEMENT ACTIONS/COMPLIANCE <br /> <br />No enforcement actions were initiated as a result of this inspection, nor are any pending. <br />
