The bond release application was found complete by this Division on February 16, 2017.
This application requests Phase III Bond Release of 422 acres. This application includes the
bond release blocks (BRB 4), which were a part of the Seneca II Mine permit until the area
became part of the Peabody Sage Creek Mine (PSCM) Permit in 2012. The area received Phase
I release under the Seneca II Mine permit. The area is now refered to as BRB PSCM-2. The
area received Phase II bond release under the PSCM permit. A Corporate Surety bond in the
amount of $3,356,429.28 is currenlty in place. The surface ownership is federal, state and
private, and the coal mined was federal, state and private.

We will contact you to advise you of the Division's required bond release inspection of the site as
soon as it has been scheduled. A proposed decision on the application will be issued within sixty
(60) days of our inspection.

If you have questions or need additional information, please contact me.

Sincerely,

Tabetha N.
