RN-04 2.03-15 02/17 Modification No. 4 to Federal Coal Lease COC-61209 provides right of entry to mine coal from the following lands in Delta County, Colorado: Township 13 South, Range 91 West, 6th P.M. Section 5: SW/4NW/4, NW/4SW/4, SW/4SW/4, NE/4SW/4, S/2NE/4SE/4NW/4, S/2SE/4NW/4, S/2NW/4SE/4NW/4, SW/4SW/4NE/4, S/2NW/4SW/4NE/4, W/2NW/4SE/4; Section 6: SE/4NE/4 Containing approximately 265.00 acres. The legal description of the lease modification is included in the above 4,168.95 acre federal coal lease description. Federal Coal Lease COC75916 was to provide right of entry to mine coal from certain lands in Delta County, Colorado. The Operator does not currently hold the coal lease. The lands in Delta County are described below: Township 12 South, Range 91 West, 6th P.M. Section 31: Lots 11 - 26 Section 32: Lots 10 - 15 Township 13 South, Range 91 West, 6th P.M. Section 5: E2SWNE, N2NWSWNE, N2N2SENW, N2NENESE NENWNESE, W2W2NESE, E2NWSE, Lots 2,3,4,10,11 Section 6: Lots 1 - 4 Township 12 South, Range 92 West, 6th P.M. Section 36: S/2 Township 13 South, Range 92 West, 6th P.M. Section 1: Lots 5 - 8 Containing 1790.2 acres more or less The Union Pacific Railroad gave Bowie Resources LLC its consent to construct and operate a unit train loadout on Union Pacific right-of-way. A letter documenting the agreement from the Union Pacific Railroad is presented in Volume III, Tab 1.
