<br />A-16 <br />• No surface activity, except subsidence, would occur within a one-quarter mile radius <br />of winter roosts between November 15 and March 15. Development may be <br />permitted at other periods. If periodic visits are required within the buffer zone after <br />development, activity would be restricted to the hours of 10:00 a.m. and 2:00 p.m. <br />from November 15 through March 15. <br /> <br />CRITERION 13 <br />Federal lands containing a falcon (excluding kestrel) cliff nesting site with an active nest and <br />buffer zone of federal land around the nest site shall be considered unsuitable. Consideration of <br />availability of habitat for prey species and of terrain shall be included in the determination of <br />buffer zones. Buffer zones shall be determined in consultation with the Fish and Wildlife <br />Service. <br /> <br />Exceptions <br />A lease may be issued where the surface management agency, after consultation with the Fish <br />and Wildlife Service, determines that all or certain stipulated methods of coal mining will not <br />adversely affect the falcon habitat during the periods when such habitat is used by the falcons. <br /> <br />Analysis <br />An active peregrine falcon nest is located in the upper end of Dove Gulch. This is the only <br />active peregrine nest known to occur in this general area. The nest is located over a high ridge <br />and would be than two miles from any activity associated with road and pad construction and <br />drilling activity. It is not expected to be affected by the activities associated with the LBA tract. <br />Lands are suitable for coal leasing after applying the exceptions to the criteria. <br /> <br />With respect to peregrine falcon nests which may be established in the review area during the life <br />of the project, the following special stipulations would be applied (also see Criterion 14 for <br />additional conditions): <br />1. No new permanent surface facilities or disturbance would be located within a one-quarter <br />mile radius buffer zone around each peregrine falcon nest site. <br />2. No aboveground activities would be allowed within a one-half mile radius buffer zone <br />around each active peregrine falcon nest site from February 1 to July 15. <br />3. Any proposed surface facilities, disturbance, or activities in, or adjacent to, these buffer <br />zones would require approval from the USFS or BLM on a site-specific basis, after <br />consultation with the U.S. Fish and Wildlife Service. <br />CRITERION 14 <br />Federal lands which are high priority habitat for migratory bird species of high federal interest on <br />a regional or national basis, as determined jointly by the surface management agency and the <br />Fish and Wildlife Service, shall be considered unsuitable. <br /> <br />Exceptions <br />A lease may be issued where the surface management agency, after consultation with the Fish <br />and Wildlife Service, determines that all or certain stipulated methods of coal mining will not
