V. COLORADO
Division of Reclamation,
Mining and Safety
Department of Natural Resources
1313 Sherman Street, Room 215
Denver, CO 80203
February 14, 2017
Mr. Tom Bird, Manager of Coal Services
GCC Energy, LLC
6473 County Road 120
Hesperus, CO 81326
RE: King Coal Mine, Permit C-1981-035. Review of 2016 ARR.
Dear Mr. Bird:
The Colorado Division of Reclamation, Mining and Safety (Division) has reviewed your 2016 Annual
Reclamation Report (ARR) for accuracy and in the context of Rule 2.04.13. We received this document
on February 9, 2017, thus GCC is in compliance with the requirement to submit a given ARR by
February 15`l' of the following year. The 2016 ARR contains the required information listed in Rule
2.04.13(1), however, GCC should submit a form with all of the permit combined, including both
King I and King II. It is very useful to also provide supporting information (form or table or other
format) that shows the values for King I by itself and King II by itself (as you have done).
The acreage values on the submitted forms appear to be accurate with the following exceptions:
• The values in long-term mining or reclamation facilities (23.60 acres on the King I form) should
be less than or equal to the total amount of disturbed acres (15.42 acres on the same form).
Please address this error on the King I form and provide the Division with an explanation
of the source of the value of 23.60 acres.
It appears that the amount of seeded acreage for King I should have 0.3 acre in the "Greater than
10 years" category, rather than have all of the acreage in the "10 years or less" category. Please
make this correction or explain why it is not necessary.
The values for active mining areas should be zero since this is an underground mine, and there are
no pits or spoil piles. Pits and spoil piles are features that are found at surface mines. This error
is relevant to both forms (King I and King II) and should be corrected.
The Division suggests the following improvement to the submitted maps (for future reference in
subsequent ARR submittals). No lines or hatching should be the same color as the polygons for
"Reclaimed Areas." This suggestion is relevant to both maps (King I and King Il).
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us
John W.
