Nelson <br />(1926-1992) <br />This letter is in response to your November 4, 2016 letter addressed to Tonya <br />Hammond of the Snowcap Coal Company ("SCC"). Through that letter, the Division of <br />Reclamation, Mining and Safety (the "Division") is requesting certain follow-up information <br />regarding SCC's Technical Revision 69 application ("711--69"), including a `Metter from the <br />landowner stating that they concur with the proposed reclamation plan" for SCC's <br />hydrological repair. While we disagree that Rule 2.05.5(1)(b) requires SCC to provide such a <br />letter, Mr. Beckwith's comments submitted to the Division on October 27, 2016 on behalf of <br />the landowners (Rudolph and Ethel Fontanari as trustees of the Rudolph and Ethel Fontanari <br />Revocable Living Trust ("Fontanari")), confirm that it would be impossible to obtain such a <br />letter from Fontanari. Further, a letter indicating such approval or concurrence by the <br />"landowner" is unnecessary in this matter in any event because SCC reserved easement <br />rights on the pertinent property, prior to any conveyance to Fontanari or its predecessors, for <br />reclamation purposes, which evidence adequate prior consent by the "landowner" for <br />purposes of approving TR -69 and its associated reclamation plan. , <br />Rule 2.05.5(1)(b) states that "[t]he description shall be accompanied by a copy of the <br />comments concerning the proposed use by the legal or equitable owner of record of the <br />surface of the proposed permit area..."
