Stipulations for McCabe Lane Community Pit <br /> 1. Volume slips, scale tickets and/or truckloads of removed material will be <br /> furnished by the purchaser upon demand at any time during and at the close of <br /> this operation. <br /> 2. The quarry site will be maintained in an uncluttered and orderly manner, no <br /> housing structures will be allowed on the land and all garbage and waste material <br /> will be disposed of properly offske. <br /> 3. Changes or improvements of the access road to the quarry site will be done only <br /> with prior approval of the Authorized Officer(AO). <br /> 4. Materials may be removed only from the designated area on the ground;this <br /> area will be identified to the AO to avoid conflicts with other operators. New <br /> areas will be opened as deemed necessary to the limits of the established pit. <br /> 5. Removal of material will not be allowed within 20 feet of the county road. <br /> 6. The mineral materials will be broken, ripped or loosened from the formation by <br /> means other than blasting when practical; blasting will be allowed on a case by <br /> case basis and will adhere to the following requirements: a) prior to blasting, the <br /> operator shall notify the Authorized Officer of the date of blasting and provide a <br /> copy of a current permit and/or license which authorizes the use of explosive <br /> materials, b)the use of explosive materials will be in strict conformance with <br /> current state laws, c) under no circumstances will explosive materials be <br /> permitted to be stored at the pit, d)explosive materials will not be used if such <br /> use will interfere with any other operator's activity in the pit area. <br /> 7. The pemmittee may remove only material that he or his representatives have <br /> ripped, prepared and piled. <br /> B. No one person, company or agency shall have exclusive use of the pit. <br /> Procedures for exclusive sales(competitive and non-competitive)can be found in <br /> 43 CFR 3600. <br /> 9. Topsoil will be pushed to the side for use in the reclamation of the land. In no <br /> case may the topsoil be removed from the land. If the topsoil Is to be stockpiled <br /> for an extended period(6 months or longer),the sides of the pile will be sloped In <br /> a manner that will minimize wind and water erosion. Furthermore, the BLM <br /> representative will be contacted to seed the stockpile(s). <br /> 10.Wails of the pit will be smoothed and sloped to 3:1 upon expiration of the permit <br /> or when the pit has been mined out. <br /> 11. Oversize rock that is not used or hauled away will be buried at least one and a <br /> half feet(15)below the surface;topsoil will then be placed over the area and <br /> smoothed over so as to be conducive to seeding. <br /> 12. BLM is the landowner and not considered the operator. As such, operators <br /> processing materials within the community pit(by stung, crushing, etc.)fall under <br /> Mine Safety and Health Administration(MSHA) regulations and are required to <br /> follow all MSHA regulations while operating at the community pit. <br /> 13.These stipulations are in addition to those included in the issued contract or <br /> permit <br /> I acknowledge revel d review of the above stipulations. <br /> Operator's Initials: <br />
