RULE 2.04 - APPLICATION FOR PERMIT FOR SURFACE OR UNDERGROUND MINING <br />ACTIVITIES - MINIMUM REQUIREMENTS FOR INFORMATION ON ENVIRONMENTAL <br />• RESOURCES <br />RULE 2.04.1 - OBJECTIVES <br />The objectives of 2.04 are to ensure that each application provides the Division a complete and accurate <br />description of the environmental resources that may be impacted or affected by proposed surface coal mining <br />operations. <br />RULE 2.04.2 - RESPONSIBII.,ITIES <br />(1) It is the responsibility of the applicant to provide except where specifically exempted. all <br />information required by 2.04 in the application. <br />(2) It is the responsibility of State and Federal govemment agencies to provide information for <br />a pplications as specifically required by 2.04. <br />RESPONSE <br />Within this Section of the permit application, Twentymile Coal, LLC, or predecessor companies (TCC) <br />provides complete and accurate descriptions of the environmental resources that either have been or may be <br />impacted or affected by the underground mining operations and the associated surface activities. <br />RUI:.E 2.04.3 - GENER:AL REQUIREMENTS: SITE DESCRIPTION AND LAND USE INFORMATION <br />• (1) Each permit application shall include a description of the existing, premming environmental <br />resources within the proposed permit area and adjacent areas that may be affected or impacted by the imposed <br />surface or und.ei-ground minim activities. <br />("2) The application shall contain a statement of the condition capability, and productivity of the land <br />withi the proposed permit area, except for underground minina which shall cover only those areas affected or to b <br />af fected by surface operations and facilities. including: <br />(a) A map, prepared according to the requirements of 2.10. and supportin—narrative of the <br />uses of the land existing at the time of the filing of the application in accordance with land use categories <br />established in the land use definition in 1..04. If the premining use of the land was changed within the five ,years <br />prior to the date operations are proposed to begin, the historic use of the land shall also be described <br />(b)_ A narrative of land capability and productivity whi analyzes the land -use descri <br />under in c with other environment resources . information required under 2.04.3. Th <br />narrative shall provide analyses of <br />(i) The capab:i.lity of the land before any mining to support a variety of uses riviiiL' <br />consideration to soil and foundation characteristics, topography. vegetative cover and the hydrology of the <br />proposed permit area; and <br />"ii) The productivity of the proposed permit area before mining expressed as average. <br />yield of food, fiber, forage, or wood products from such lands obtained under high levels of management The <br />productivity shall be determined by yield data or estimates for similar sites based on current data from the U.S. <br />MR10 -241 2.04 -1 03/05/10 <br />
