undermining, a contractor will backfill the potentially affected pipeline segment, and will then reclaim, stabilize, and <br />revegetate the site. Final stabilization and reclamation of the pipeline and pipeline corridor, including any temporary <br />access road, will be the pipeline owner's responsibility. vGiven that the pipeline owner will be creating the <br />disturbance associated with the pipeline work, and is also doing the reclamation work, MCM will not assume <br />reclamation liability for the work. <br />In the event that any oil leaks or spills due to damage to the pipeline, any oil that collects on the surface or in the <br />containment system will be recovered by a qualified contractor using a portable vacuum -truck, transported off-site, <br />and recycled or disposed of in full compliance with applicable regulations. Similarly, any petroleum contaminated <br />soil will be recovered, hauled off-site, and land -farmed or disposed of in an appropriate manner. <br />County Road 107 <br />County Road 107, which traverses the property from the southwest to the northeast, is an unimproved gravel road <br />maintained by MCM. This road has been abandoned by the County to the northeast of the mine complex and has been <br />vacated to MCM. Subsidence is planned under portions of the existing road right-of-way. MCM proposes to <br />maintain the road as necessary for its own use. <br />State Highway 13 <br />State Highway 13 will be outside the area of possible surface subsidence effects, however, MCM plans to monitor <br />State Highway 13 in any areas where mining occurs in reasonable proximity to the road. In the unlikely and highly <br />improbable event that subsidence impacts State Highway 13, the road will be barricaded, if necessary, after notifying <br />the appropriate authorities. Once any public safety considerations have been addressed through notification of the <br />authorities of the potential hazardous condition, and appropriate safety measures have been implemented, any <br />necessary repair work will be initiated. Any necessary repair work will be carried out under the direction of the State <br />Highway Department, and will be reimbursed by MCM. <br />Union Pacific (formerly Denver and Rio Grande Railroad) Spur <br />The UP railroad spur is currently outside the area of possible subsidence effects, however, life -of -mine mining may <br />result in limited undermining of the railroad spur. In the potentially affected area, MCM will develop a monitoring <br />program and submit it to the CDRMS for review and approval. If the monitoring program indicates any significant <br />subsidence impacts to the railroad spur, MCM will immediately notify the UP Railroad and the appropriate agencies. <br />MCM will coordinate with UP on any necessary stabilization or repair of the railroad spur, with any work to be <br />carried out under the direction of the UP Railroad. <br />Irriaation Ditches <br />The irrigation ditches are outside of the area of possible subsidence effects, however, life -of- mine mining may <br />result in limited undermining of the irrigation ditches. In these areas, MCM will develop a monitoring program and <br />submit it to the CDRMS for review and approval. If the monitoring program indicates that subsidence is impacting <br />the irrigation ditches, MCM will repair or replace the damaged ditches or ditch segments, at their option. <br />TR14-36 2.05-65 Revised 03/10/14 <br />
