Ebert, Environmental Protection Specialist <br />CC: Division 1 Office, District 2 Water Commissioner <br />FROM: Ioana Comaniciu, P.E. <br />RE: Nyholt Pit (aka Mann Pit), File No. M-1982-147-AR01 <br /> Operator: Adams County (303) 637-8006 <br /> Sec. 34, Twp. 1 South, Rng. 67 West, 6th P.M., Adams County <br /> <br /> <br />COMMENTS: <br />Adams County has submitted a request for partial acreage release for 50.45 acres permitted area <br />of the Nyholt Pit (aka Mann Pit), Permit No. M-1982-147. The site consists of 3 lined storage <br />reservoirs (Mann Lakes, WDID 0203911) and one unlined reservoir (Nyholt-Mann Lake Pit, WDID <br />0210294). A plan for augmentation was decreed for replacement of evaporation in Division 1 Water <br />Court Case no. 2005CW146. According to the decree granted in case no. 2005CW146 the water <br />surface area of the Nyholt-Mann Lake is 65.5 acres of which 14 acres was exposed prior to January <br />1, 1981. <br /> <br />The State Engineer’s Office has no objection to the request for partial acreage release for the <br />Nyholt Pit (aka Mann Pit), provided the pit will continue to be operated in accordance with the <br />terms and conditions of the decree in case no. 2005CW146. In addition, the Applicant must release <br />all out-of-priority storage in the Nyholt-Mann Lake within 72 hours or augment such out-of-priority <br />storage under a SWSP or court approved augmentation plan. In order to assure that water is not <br />being stored out-of-priority the Applicant must install measuring and recording devices as required <br />by the division engineer and water commissioner to measure the amount of water flowing into and <br />out of Nyholt-Mann Lake. <br />The applicant may contact the State Engineer’s Office with any questions. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
