Dear Ms. Brannon,
On behalf of the citizens and property owners (Pueblo County Aggregate
Opposition Committee) against and very concerned about the mining operation
identified above, we are submitting this letter and the accompanying documents
as further evidence as to why this permit should be revoked.
We understand that this permit will once again come before the Mining and
Reclamation Board on February 22, 2017, on an appeal for reconsideration.
Please place this information into consideration in regards to the permit # M2016-
009.
In reviewing the DRMS file we have come across very important information that
was over looked or was completely misrepresented by Fremont Paving and Redi-
Mix, Inc., Mr. John P. Ary and Dr. Angela Bellantoni of Environmental
Alternatives, Inc.This information is in regards to the Bessemer Ditch and the
close proximity of what is known as the "North Haul Route".
It was the testimony of the applicant, that the mining operation was no closer than a
quarter of a mile to the Bessemer Ditch. The applicant used the North-West corner of
phase II of the mining project. They presented a direct diagonal line from the North-
West corner of Phase II down slope to the Bessemer Ditch. That measurement is
correct, however they choose not to comment on the close proximity of the "North Haul
Route".
With the assistance of Jimenez Garcia (Dominga), Planner 2, of the Pueblo County
Planning and Development Department we have enclosed copies of pictures taken of
one of Fremont's architectural drawings that are on file in the Planning Department. In
the photographs Dominga is the one holding the architectural ruler, while Wendi Kern
took the photos.
