(SCC), has conducted investigations <br /> and submitted revisions to their coal mining permit (C1981041) i n <br /> accordance with the October 2015 DRMS order to determine <br /> the extent of certain identified hydrologic communication existing between <br /> the underground workings of the Roadside Mine subject to the SCC permit and <br /> parts of the properties overlying these workings that belong to Mr. Rudolph <br /> Fontanari and Mr. Jason Carey. The results of the investigation and subsequent <br /> repair plan submitted by SCC in compliance with the order are currently under <br /> review by DRMS Coal Division. <br /> Mr. Fontanari's attorney, James Beckwith, has submitted comments on behalf of <br /> his client in the context of DRMS's review of SCC's compliance with DRMS's <br /> order. Mr. Beckwith has now submitted a letter dated January 5, 2017 to DRMS <br /> which calls out certain test pits and borings conducted by Mr. Fontanari and <br /> questions SCC's responses submitted to the DRMS Coal Division. <br /> In the fall of 2015, it is SCC's understanding that Mr. Fontanari conducted <br /> exploration work in the same general area as SCC's hydrologic communication <br /> investigation. The exploration work included excavation of two test pits and <br /> drilling a number of exploration holes, the majority of which were outside of what <br /> SCC understands to be Fontanari's permit boundary.
