(SCC), has conducted investigations and submitted revisions to their coal mining permit (C1981041) i n accordance with the October 2015 DRMS order to determine the extent of certain identified hydrologic communication existing between the underground workings of the Roadside Mine subject to the SCC permit and parts of the properties overlying these workings that belong to Mr. Rudolph Fontanari and Mr. Jason Carey. The results of the investigation and subsequent repair plan submitted by SCC in compliance with the order are currently under review by DRMS Coal Division. Mr. Fontanari's attorney, James Beckwith, has submitted comments on behalf of his client in the context of DRMS's review of SCC's compliance with DRMS's order. Mr. Beckwith has now submitted a letter dated January 5, 2017 to DRMS which calls out certain test pits and borings conducted by Mr. Fontanari and questions SCC's responses submitted to the DRMS Coal Division. In the fall of 2015, it is SCC's understanding that Mr. Fontanari conducted exploration work in the same general area as SCC's hydrologic communication investigation. The exploration work included excavation of two test pits and drilling a number of exploration holes, the majority of which were outside of what SCC understands to be Fontanari's permit boundary.
