7. At a herring during the Hoard's June 22, 2016 meeting, the Operator requested
sin extension until Oftber IS, 2016, to complete all to pdred corrective adios in the March
2016Order. As grounds forthe extension the Qperator testifiedt at the VS. Army Corps of
Engineers requires a study before granting the Operator a permit for a culvert that is needed
as partof the reclamation of Little Deadwood Gulch at the May Day 2 and Chief Portal. The
Division objected to the extent of the request and argued that theextension should be

The Division argued that the study required by the US. Array Corps of Engineers does not
