At Its cog dar meeting on December 16, 2015, the Board Feld an enFarcemsat <br />hearing to madder a possible AdW&m fry Operator, cf4 penaltias„ pe n krevocation, and <br />forfeltuve of flaandd warratly foE failure to mW* with, the conditbu of a Board order, <br />pannIt number M-1981-185. The Board tabled the matter to Its January 27, 2016, regular <br />meeting for the stated purpose of allowing Operator an opportunity to prepare a response <br />to the Hoard's inquiry into Operator's finandal ablilty to completa corrective actions and <br />prograas toward completing the corrective actions. <br />3. During the <br />January 27, 2016. hearing the parties presented an agreement far settlement of this rem iter, <br />which the Hoard approved. <br />4. Tha:lloard Issued an order dated Manch 3, 2016 ('March 2016 Ordee). In the <br />March 2020 Order. the Board found dat the Op nww was Inv[ol non alsection 84-32- <br />124[6] [a], C.R.S. for failure to comply with the conditions of its permit by falling to comply <br />with the conditions of a Board order, specdflwlly the Hoard order Aped and effective <br />February 21, 2014, ragniring Operator to complete all outstanding corrective actions set <br />Forth in dee December 2011 Order.
